What kind of person, what deeply flawed kind of person would hit a pedestrian with a motor vehicle and then flee the scene leaving the pedestrian to die alone in the gutter? For my way of thinking I can’t print what I think about them.

Crashes involving bicycles and automobiles have slowly risen over the past five years in both Nashville and Tennessee, as more and more people pedal for business or recreation. A Washington County, Tennessee bike rider was riding in the middle of Highway 36 near Orchard Lane in Boones Creek at 10 PM Tuesday. His bicycle did not have lights or reflectors, nor did he have reflective clothing.

He was run over by a vehicle that failed to stop and render assistance and then moments later he was run over by another vehicle. Another car ran over the bicycle. Police a re looking for the Hit & Run driver.

Nashville Auto Accident Lawyer Suggests Ways To Keep Drunk Drivers Off The Road

The other day I wrote on these pages about a 28-year-old Tullahoma woman who was hit by a pickup truck that subsequently left the scene of the accident. In that Blog I suggested that the driver was probably drunk, had lost his/her license for drunk driving related charges in the past, or had no insurance.

Local news media reported today that police arrested the driver and charged him with leaving the scene of an accident and driving on a revoked license. Other charges are pending.

This is a problem that is becoming increasingly acute, drivers who violate the law, lose their licenses and then take to the roads again, ignoring, or thumbing their nose at the law and the safety of others.

Despite improvements in US laws, it still is difficult to detect and arrest alcohol-impaired drivers once they are driving. The estimated chance of arrest when driving with an illegal BAC is less than 1 in 50. A preferable strategy would be to identify impaired drivers before they start the vehicle and prevent them from driving.

There is technology available to accomplish this, and today almost all states have laws that restrict some people convicted of DWI from driving unless their vehicles have been equipped with alcohol ignition interlocks.

These devices have a breath-testing unit that is connected to the vehicle ignition. To start the vehicle, the offender must blow into the device and register a blood alcohol reading below a predetermined level, typically set well below a BAC of 0.08%, the per se threshold for DWI in all states. Ignition interlock restrictions have been shown to be effective at reducing recidivism among repeat offenders, at least while the restriction is in place.

Until recently, laws requiring convicted DWI offenders to install interlocks pertained to repeat offenders or to first offenders with very high BACs (typically 0.15% or higher). However, as of September 2009, 12 states have expanded the interlock requirement to apply to all offenders, including first-time offenders. These states are Alaska, Arizona, Arkansas, Colorado, Hawaii, Illinois, Louisiana, Nebraska, New Mexico, Oregon, Utah, and Washington.

In Tennessee the legislature, passed a law requiring all those convicted of DUI to  use the interlock device on their vehicle. The act also prohibits them from driving vehicle without the devices.

In 2007, the male pedestrian fatality rate per 100,000 population was 2.19 — more than double the rate for females (0.91 per 100,000 population). In 2007, the male pedestrian injury rate per 100,000 population was 26, compared with 20 for females.

In a local media article this week we find that Tennessee Highway Patrol troopers and Mt. Juliet Police believe that a hit-and-run on Interstate 40 eastbound killed a pedestrian early Wednesday and caused two other accidents. The initial vehicle left the scene of the accident and is being sought by police. Some time during the period 3:30 AM to 5:15 AM a man was hit by a car on I-40 in the East bound lane. Some time later drivers trying to avoid the man’s body in the interstate swerved and ran off of the road.

As an experienced Nashville auto accident lawyer I have become well acquanted with the Forrest Gump rule of “…stupid is as stupid does.” This guy is a powerful example of that rule.

In order to avoid a possible DUI citation a Campbell County Tennessee man ends up charged with criminally negligent homicide, leaving the scene of an accident involving death and filing a false police report. This is good example of the kind of good thinking you do when you are under the influence, but hey, he didn’t get a DUI.

According to local news articles the 29-year-old man was driving along at about 11PM when he struck a pedestrian who was walking home from work. The other man was also 29-years-old and his body was found lying alongside the road at 7 AM the following morning. According to police investigators they were able to determine the make and color of the truck from debris left at the scene of the crash.

The driver filed a police report the following day saying that his yellow GMC pickup truck had been stolen sometime the evening before. Another stupid move. Police found the vehicle abandoned in a secluded area and arrested the owner-driver a short time later.

Those of you who are regular readers of this blog know how I feel about people who hit and possible kill another human being and resist the normal urge to stop, get out and help that person, but instead drive off and hide, leaving the unfortunate victim to die in an effort to avoid responsibility for their dastardly deed.

This tragic Nashville automobile accident started when a Nashville woman was driving along I-24 when she for some reason lost control of her car hit a guardrail.
