
Interstate Traffic Fatality
I’ve had a hard time writing this blog, as an experienced Tennessee automobile accident attorney, I’ve seen my share of horrible wrecks caused by drunken drivers, but an accident in Nashville this past Thursday has left me numb. How does a driver get onto a busy Interstate highway going the wrong way?
Just this past week we wrote about an 80-year-old Knoxville man who did just that. His error lead to him crashing into a gasoline tanker truck and several other cars, fortunately no one was killed. The most recent Tennessee records available are from 2010 and show that we had a disproportionate number of wrong-way crashes that year, according to the National Highway Traffic Safety Administration. There were 1,005 fatal crashes involving wrong-way drivers in the United States that year, 105 of those in Tennessee.
The driver got on to I-65 going the wrong way and within minutes she slammed head-on into the victim. Photos of the cars show clearly how bad the impact was. The victim, a 29-year-old Nashville woman, was working her route as a Pepsi salesperson at 4 A.M. when she was killed. My prayers go out to the family and friends of this young woman, as well as the driver that caused this tragedy.
In the case I’m referring to, police investigators are certain that the cause was alcohol. A witness who stopped to render aide said the driver appeared to be drunk and when he inquired as to her condition she cursed him.
Drunk driving is one of America’s deadliest crimes. In Tennessee in 2008, 327 people were killed in crashes where the driver or motorcyclist had a blood alcohol concentration (BAC) of .08 or higher. There is another important aspect to this investigation, and that is where had this woman been drinking prior to the accident?
The Tennessee Dram Shop law establishes liability arising out of the irresponsible sale or provision of alcohol to obviously intoxicated persons or minors who subsequently cause death or injury to third parties as a result of alcohol-related car crashes and other accidents.
