Wife Dead, Man Faces Prison Time In Tennessee Roadway Departure Crash

Drinking, Driving, No Seat Belts

Drinking, Driving, No Seat Belts

A 25-year-old Murfreesboro woman is dead after a one car crash on I-24. Local media reports are light on the fact but suffice to say that the woman and her husband had been drinking, they were not wearing their seat belts and the driver lost control and struck an embankment, causing he and his wife to be ejected.

According to the media report, police intend to charge the man in the death. In many case like this wearing seat belts can mean the difference between life and death, and prison.

As an experienced Tennessee car accident lawyer I want to remind you that driving with a BAC of .08 or higher is illegal in every state. If you follow my blog you will see that in Tennessee we continue to see a tragic number of people with debilitating injuries and deaths as a result of impaired driving. This careless disregard for human life must stop.

Drunk driving is one of America’s deadliest crimes. In Tennessee in 2008, 327 people were killed in crashes where the driver or motorcyclist had a blood alcohol concentration (BAC) of .08 or higher. That is down from 377 people killed in 2007 with a BAC of .08 or higher. Over the 2008 Labor Day holiday, 12 people were killed in 10 fatal crashes on Tennessee roadways, down from 17 people killed on Tennessee roadways in 2007.

Drunk Wrong Way Nashville Driver Crashes And Kills Another Woman

Interstate Traffic Fatality

Interstate Traffic Fatality

I’ve had a hard time writing this blog, as an experienced Tennessee automobile accident attorney, I’ve seen my share of horrible wrecks caused by drunken drivers, but an accident in Nashville this past Thursday has left me numb. How does a driver get onto a busy Interstate highway going the wrong way?

Just this past week we wrote about an 80-year-old Knoxville man who did just that. His error lead to him crashing into a gasoline tanker truck and several other cars, fortunately no one was killed. The most recent Tennessee records available are from 2010 and show that we had a disproportionate number of wrong-way crashes that year, according to the National Highway Traffic Safety Administration. There were 1,005 fatal crashes involving wrong-way drivers in the United States that year, 105 of those in Tennessee.

The driver got on to I-65 going the wrong way and within minutes she slammed head-on into the victim. Photos of the cars show clearly how bad the impact was. The victim, a 29-year-old Nashville woman, was working her route as a Pepsi salesperson at 4 A.M. when she was killed. My prayers go out to the family and friends of this young woman, as well as the driver that caused this tragedy.

In the case I’m referring to, police investigators are certain that the cause was alcohol. A witness who stopped to render aide said the driver appeared to be drunk and when he inquired as to her condition she cursed him.

Drunk driving is one of America’s deadliest crimes. In Tennessee in 2008, 327 people were killed in crashes where the driver or motorcyclist had a blood alcohol concentration (BAC) of .08 or higher. There is another important aspect to this investigation, and that is where had this woman been drinking prior to the accident?

The Tennessee Dram Shop law establishes liability arising out of the irresponsible sale or provision of alcohol to obviously intoxicated persons or minors who subsequently cause death or injury to third parties as a result of alcohol-related car crashes and other accidents. I will keep up with this case and report later on the outcome.

If you or a loved one is injured or killed in a Tennessee automobile accident caused by a drunk driver and you hope to recover all of the damages the law allows you need to consult with an experienced Tennessee automobile accident attorney like those at Phillip Miller & Associates. We offer a free consultation so that you can gain the information you will need to face this odyssey through the legal system. Call 615-356-2000.

Memphis Van Driver Wasn’t Paying Attention While He Drove And Talked On Cell Phone

Passenger Vans Require Special Care

Passenger Vans Require Special Care

Passenger vans are inherently dangerous for a number of reasons. The driver of a passenger van carrying young children owes a special duty of care to transport the children safely and without incident. A three-vehicle accident in Memphis on Friday shows just what can happen when the driver allows himself to be distracted.

Facts about what happened are somewhat sketchy in the local media report but the comment of a 6-year-old male passenger tells the story. The young man said that the driver wasn’t paying attention, that he was just driving along talking on his cell phone when the accident happened. None of the children were hurt but occupants of the two other cars were transported to local hospitals.

Federal regulations prohibit commercial drivers from talking on cell phones when in motion, but I think this driver has bigger problems when his employer reviews his actions.

The lesson here, is that cell phone use distracts a driver and a cell phone distracted driver, according to studies, is a just as distracted as a legally drunk driver. Put the phone down and if you need to take or make a call, pull over and get out of traffic.
