Blind Driver Kills Pedestrian

A pedestrian with the right of way was crossing the road at a clearly marked intersection when a 58 year-old driver entered the intersection striking the pedestrian, killing her instantly. It appears that the driver failed to take any evasive action to avoid striking the pedestrian and the police determined that there was nothing that would have obstructed his view.
The Johnson City Press reports that the driver has been charged with vehicular homicide and reckless endangerment as the result of this car/pedestrian accident. There is a twist here, the Press reports. It appears that the driver/defendant is blind. That’s right, the driver/defendant is considered by the Social Security Administration to be blind to the point that he is totally disabled from working and has been receiving benefits since the 1980s. Defense attorneys for the driver are arguing that the State should not be allowed to introduce any information about the Social Security findings to the jury in the criminal case.
