A Nashville Automobile Accident Lawyer Opines On a Murfreesboro Tennessee Car Accident

Drunk or Distracted

Drunk or Distracted

As an experienced Nashville automobile accident lawyer when I look at an accident to determine responsibility and plan my approach to recovering appropriate damages for my client, I initially look at several things. The time of day is an important factor. The age, the type of vehicle and sex of the people involved in the collision can tell me a lot.

Applying that concept to a Tennessee automobile accident reported on the website of the Murfreesboro Post in which two men (Ages presently unknown) in a jeep at 12:30 AM turn their vehicle directly into the path of an oncoming police cruise in downtown Murfreesboro. The investigating officer from the THP was not available to discuss the investigation.

My experience in trying Tennessee automobile accident cases starts me off thinking about the time of day. It was thirty minutes past midnight, a jeep is normally driven, not always, by younger males and the fact that they failed to yield to an oncoming police car tells me the driver was either impaired (under the influence) or distracted while he should have been focused on the road ahead.(cell phone, texting, GPS)

According to the National Highway Traffic Safety Administration driver inattention is the leading factor in most crashes. Nearly 80 percent of crashes and 65 percent of near-crashes involved some form of driver inattention within three seconds before the event.  Primary causes of driver inattention are distracting activities, such as cell phone use, and drowsiness. . One well respected research team found epidemiological evidence suggesting that “the relative risk of being in a traffic accident while using a cell-phone is similar to the hazard associated with driving with a blood alcohol level at the legal limit”.

The other thing that occurred to me and an area of inquiry is that the driver might have been under the influence of alcohol. Every day, 36 people in the United States die, and approximately 700 more are injured, in motor vehicle crashes that involve an alcohol-impaired driver. The annual cost of alcohol-related crashes totals more than $51 billion. But there are effective measures that can help prevent injuries and deaths from alcohol-impaired driving.

According the article the Jeep passenger is hospitalized with life threatening injuries and the driver and the police officer were treated and released. I want to reiterate, I have not had an opportunity to review the THP accident report I’m relying on the article and I am making these points to explain what I, as an experienced automobile accident attorney would focus muy investigation on.
